ZigZag Spain (“we,” “our,” and “us”) is a Limited Liability Company (LLC) registered in Sacramento, California (USA), under entity number B20250400310.
These Terms and Conditions govern your booking and use of our services. By making a booking with us, you agree to be bound by the terms outlined below. Please read them carefully before proceeding.
By making a booking, the first named person (“Client”) agrees on behalf of themselves and all persons included in the booking that they:
Have read, understood, and accepted theseTerms and Conditions and have the authority to agree on behalf of all members of their party.
Consent to our use of personal data in accordance with our Privacy Policy.
Are over 18 years of age (or, if booking for minors, have parental or guardian consent as required).
Accept responsibility for payment of the booking on behalf of all individuals included in the booking confirmation.
In these Terms and Conditions, references to “you” and “your” refer to the Client and all members of their party.
1. Booking, Confirmation, and Payment
1.1. To secure a booking with us, you must complete and sign our booking form (online or physical), accept the Terms & Conditions, and pay the required deposit of 40% of the trip price. Bookings made within 12 weeks of departure, require full payment (100%).
1.2. Except in cases of Unavoidable and Extraordinary Circumstances, significant changes made by us, or trip cancellations, deposits are non-refundable.
1.3. A binding contract is established once we send you a written booking confirmation after receipt of our booking form and deposit.
1.4. Remaining balances are due no later than 12 weeks before departure, unless otherwise specified. Late payments may result in cancellation of your booking, and deposits nay be retained.
1.5. Set Departure Packages: Set departure bookings are subject to a minimum participant requirements. We reserve the right to cancel if the minimum is not met, with a full refund or an alternative offered.
1.6. Payment Methods: Bank transfer, credit card, or any method specified on our website.
2. Cancellation and Refund Policies
2.1. You may cancel your booking at any time by sending written notice to us via email. The cancellation takes effect upon our acknowledgement.
2.2. Cancellation charges apply as follows:
Period of Notification: Cancellation Charge:
Over 12 weeks ................................. Loss of deposit
12 - 6 weeks .................................... 60% of total trip cost
Less than 6 weeks ..................... 100% of total trip cost
2.3. Unavoidable and Extraordinary Circumstances (e.g., war, terrorism, natural disasters, epidemics) may allow for full refunds if your trip is significantly affected. Voluntary cancellations without such circumstances are subject to the above fees.
2.4. If we cancel a trip due to insufficient bookings or unforeseen circumstances, you will receive a full refund or an alternative trip o equivalent value.
2.5. Deposits are non-refundable except where required by law.
3. Changes to Bookings
3.1. By the Client: Changes musts be requested in writing and are subject to availability and additional costs.
3.2. By Us: Minor itinerary changes may occur for operational or safety reasons. Significant changes will be communicated promptly, and alternatives will be offered.
4. Prices
4.1. Inclusions: Accommodation, meals, local transportation, and activities detailed in the confirmed itinerary.
4.2. Exclusions: Airfare, travel insurance, visas, personal expenses, gratuities, additional activities, or unspecified meals.
4.3. Price Changes: Prices may change due to exchange rates, fuel surcharges, or taxes. Significant changes will be communicated.
5. Travel Insurance
Comprehensive travel insurance covering trip cancellation, medical expenses, personal injury, and loss of personal belongings is mandatory. You are responsible for obtaining and paying for insurance and may be required to provide proof before departure.
6. Health and Safety
6.1. Inform us of medical conditions, dietary requirements, or special needs at booking. We will try to accommodate request but cannot guarantee fulfillment.
6.2. Travelers must meet all health, vaccination, and travel requirements for their destination.
7. Liability and Responsibility
7.1. Limited Liability: Our liability is limited to the amount paid for the trip.
7.2. Exceptions: Nothing in these Terms limits liability for death or personal injury caused by our gross negligence or willful misconduct, or for fraud.
7.3. We are not responsible for actions or omissions of third-party providers, your personal belongings, or failure to follow guide instructions.
7.4. If we cannot provide significant services, we will arrange alternatives or refund the price different.
7.5. We are not liable for trip interruptions caused by Unavoidable and Extraordinary Circumstances, voluntary early departures, weather, or government-imposed restrictions unless caused by our negligence.
8. Data Protection
Your personal data, including sensitive information, may be shared with suppliers, credit checking companies, and public authorities as necessary to arrange your trip. Failure to provide required information may prevent your participation.
California Residents: You may ave rights under the CCPA/CPRA, detailed in our Privacy Policy.
9. Governing Law
These Terms and Conditions are governed by California law. Disputes are subject to the exclusive jurisdiction of California state and federal courts.
10. Amendments to Terms and Conditions
We may update these Terms and Conditions at any time. Changes will not affect confirmed bookings prior to the update. The latest version will be available on our website.
11. Minor Travelers
Bookings for minors require explicit consent from a parent or legal guardian. The parent/guardian must agree to these Terms and assume responsibility for the minor.
