ZigZag Spain (“we,” “our,” and “us”) is a part of NUMABAU, SC, a company registered in Spain under company number J-25827353, with its registered office located at Ctra. de Barcelona 2, 2n 1a, 17002 Girona (Spain).

These Terms and Conditions govern your booking and use of our services. By making a booking with us, you agree to adhere to and be bound by the terms outlined below. We kindly ask that you read them carefully before proceeding with your booking.

By making a booking, the first named person (“Client”) agrees on behalf of themselves and all persons included in the booking that they:

  • have read, understood, and accepted these booking conditions and have the authority to agree to them.

  • consent to our use of personal data in accordance with our Privacy Policy.

  • are over 18 years of age.

  • accept responsibility for payment of the booking on behalf of all individuals included in the booking confirmation.

In these booking conditions, references to “you” and “your” refer to the Client and all members of their party.

1. Booking, Confirmation, and Payment

1.1. To secure a booking with us, you must complete and sign our booking form, either online or in physical form, accept the Terms & Conditions, and provide the required deposit of 40% of the trip price. For bookings made within 12 weeks of departure, full payment of 100% of the trip price is required.

1.2. Except in cases of (i) Unavoidable and Extraordinary Circumstances (as defined below), (ii) where we make a significant change, or (iii) where we cancel your trip (as further detailed below), any deposits paid are non-refundable.

1.3. A binding contract between you and us will be established once we issue and send you a written booking confirmation after you have completed the steps outlined in paragraph 1.1 above.

1.4. The remaining balance for your trip must be paid no later than 12 weeks before the departure date (unless otherwise specified). Should the deposit and/or balance not be paid on time, we reserve the right to treat the booking as canceled by you and retain your deposit.

1.5. Set Departure Booking Conditions: Set departure package bookings are typically made well in advance of the intended departure date and are subject to a minimum number of participants. We reserve the right to cancel set departure package bookings if the minimum number of participants is not met by the deadline communicated to you at the time of booking.

1.6. Methods of Payment: We accept payment by bank transfer, credit card, or any other method specified on our website.

2. Cancellation and Refund Policies

2.1. You or any member of your party may cancel your travel arrangements at any time. Cancellations must be made in writing by the Client and sent to us via email. The cancellation will take effect on the day we acknowledge receipt of your request in our reply.

2.2. Regrettably, we incur costs when processing cancellations, and you will be required to cover these costs according to our cancellation charges outlined below:

Period of notification: Cancellation charge:

over 12 weeks ............................ loss of deposit

between 12 - 6 weeks ............. 60% of full trip cost

less than 6 weeks ................. 100% (total cost of trip)

2.3. You may cancel your booking without incurring cancellation charges if your package trip or travel to your destination is significantly impacted by Unavoidable and Extraordinary Circumstances (see definition below). In such cases, we will provide a full refund. However, if you cancel due to a reluctance to travel and your package trip has not been significantly affected as described in section 2.3 above, our standard cancellation charges outlined in section 2.2 will apply.

2.4. For the purposes of these booking conditions, “Unavoidable and Extraordinary Circumstances” refer to situations beyond our control, where the consequences could not have been avoided even with all reasonable precautions. Examples include, but are not limited to, war, acts of war, riots, civil disturbances, acts of terrorism and their consequences, significant risks to human health such as the outbreak of a serious disease, epidemic, or pandemic at the travel destination, or natural disasters such as floods, fires, earthquakes, or adverse weather conditions that make safe travel to your destination impossible.

2.5. We reserve the right to cancel any trip due to insufficient bookings or unforeseen circumstances. In such cases, a full refund will be provided, or an alternative trip will be offered.

3. Changes to Bookings

3.1. Changes by the Client: If you wish to make changes to your booking, please contact us in writing. Changes are subject to availability and may incur additional costs.

3.2. Changes by Us: We reserve the right to make minor changes to the itinerary if necessary for operational or safety reasons. In case of significant changes, we will inform you as soon as possible and offer alternatives.

4. Prices

Unless otherwise specified, the price of your trip will include all the components outlined in your confirmed itinerary.

4.1. Price Inclusions: The trip price covers accommodation, meals, transportation (once at destination), and activities as detailed in your itinerary.

4.2. Price Exclusions: The trip price does not cover airfare, travel insurance, visas, personal expenses, gratuities, additional activities not included in your itinerary, or any food and beverages not specified in your trip arrangements.

4.3. Price Changes: Prices are subject to change due to variations in exchange rates, fuel surcharges, or government taxes. We will notify you of any significant changes.

5. Travel Insurance

It is mandatory for all travelers to have comprehensive travel insurance that covers trip cancellation, medical expenses, personal injury, and loss of personal belongings. Proof of insurance may be required before departure.

6. Health and Safety

6.1. Medical Conditions and Special Requirements: You must inform us of any medical conditions, dietary requirements, or special needs at the time of booking. We will do our best to accommodate you but cannot guarantee that all special requests will be met

6.2. Health Precautions: Travelers are responsible for ensuring they meet all health and vaccination requirements for traveling.

7. Liability and Responsibility

7.1. ZigZag Spain shall not be held liable for any loss, injury, or damage arising from the actions or omissions of third parties providing services. Our liability is limited to the amount paid for the trip.

7.2. Travelers are responsible for their personal belongings and safety throughout the trip. We strongly advise adhering to the instructions provided by our guides.

7.3. Should we be unable to provide a significant portion of the travel services outlined in your itinerary, we will, where possible, arrange alternatives at no additional cost. If these alternatives result in a lower quality experience, we will refund the difference in price.

7.4. We will not be liable for any failure to perform or improper performance of the travel services included in your package trip if the failure is due to:

  • Your actions or those of another member of your group.

  • Unforeseeable or unavoidable failures attributable to third parties unrelated to the provision of the travel services.

  • Unavoidable and Extraordinary Circumstances.

7.5. Should you choose to cut short your trip after it has commenced and this decision is not due to our failure to perform or improper performance of the travel services, we will not be responsible for any refunds for unused travel services.

7.6. Please be aware that we cannot guarantee weather conditions during your trip. Additionally, severe drought conditions may lead to local authorities imposing water use restrictions. We will make every effort to minimize any inconvenience caused by such circumstances. Except in cases where (i) the situation leads to Unavoidable and Extraordinary Circumstances, (ii) we are compelled to make significant changes to your package prior to departure, or (iii) the situation constitutes improper performance or our failure to fulfill the contract, we shall not be liable.

8. Data Protection

To process your booking and ensure the smooth execution of your trip arrangements, we will need to share the data you provide (including sensitive information, details related to minors, your name, passport details, address, and dietary requirements) with our suppliers. These suppliers may include, but are not limited to, accommodation providers, transfer companies, and other relevant organizations. Additionally, your data may be shared with credit checking companies and public authorities such as customs and immigration if required by them or by law. Failure to share this information may prevent us from arranging your trip.

9. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Spain. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Spain

10. Amendments to Terms and Conditions

ZigZag Spain reserves the right to update or amend these Terms and Conditions at any time without prior notice. The latest version will be available on our website.
